Associate General Counsel - Mortgage Litigation

Job Description:
Title: Senior Director, Associate General Counsel - Mortgage Litigation

The Litigation Group of the Legal Department is seeking a senior attorney to manage mortgage-related litigation. This Associate General Counsel position will report directly to the Chief Counsel, Litigation and be responsible for:

  • Leading a team of attorneys and paralegals in handling all mortgage-related litigation for Capital One and its affiliates;
  • Developing litigation strategy, managing outside counsel, and protecting the company’s litigation interests;
  • Identifying and analyzing potential litigation risks affecting the company’s mortgage businesses and recommending risk mitigants;
  • Directing the work of and developing other associates in the Litigation Group, including attorneys and paralegals.

    This role also will involve regular interaction with mortgage attorneys not on the litigation team and with senior business executives in the risk department, the mortgage product development team, the internal government relations team, and other teams. Strong influencing and collaboration skills are a must.

    Job Experience:
    Basic Qualifications:
    • JD and admission to at least one state bar
    • Six years of litigation experience, with 3 of those years focused on mortgage litigation.

    Preferred:
    • 8-15+ years of litigation experience in a major law firm or Fortune company in-house legal department, including significant mortgage litigation experience.
    • In-house, corporate legal experience
    • Complex, class action and/or financial services litigation experience
    • Dispute resolution experience, including negotiating in mediation and arbitration
    • Significant state and federal litigation experience, including motions practice, class certification, appellate practice, and extensive discovery
    • Ability to work effectively both in teams and independently; to make effective, integrated decisions; and to collaborate effectively with associates at all levels in the company
    • Ability to prioritize a significant volume of litigation matters and to manage multiple, simultaneous deadlines
    • Excellent written and oral communication skills with the ability to influence others
    • Management experience regarding both extensive caseload (for example, as the primary law firm or in-house attorney) and people (including junior attorneys and paralegals) management
    • 50-55+ hours per week plus availability to travel
    • Willingness to work and travel to corporate offices in New York, New York; McLean, Virginia; or Richmond, Virginia.
