JOB DESCRIPTION:
Summary:
Provide Construction Defect claim handling in areas of coverage, investigation, evaluation, negotiation, litigation management, and resolution of serious and complex commercial lines and construction liability claims to improve pay out. Provide technical consulting and training resources to Claim Service Centers and underwriting partners.
Primary Duties and Responsibilities:
Direct handle the Company's most serious or complex construction defect liability claims within assigned territory.
Provide efficient, prompt, courteous service and communication to internal business partners and external customers, about resolution of coverage, liability, reserves and other claim service issues. When appropriate, assures responses to inquiries and requests from the public.
Litigation Management through selection of counsel, evaluation and direction of claim and litigation strategy.
Establish and maintain appropriate and timely case reserves.
Effective and efficient management of allocated loss adjustment expenses.
Implement Company claim policies, procedures, practices and standards for handling of claims.
Develop and employ creative resolution strategies.
Prepare timely and informative management reports (Claim File Analysis) and presentation materials.
Represent the company as a technical resource, attend legal proceedings as needed, act within established professional guidelines as well as applicable state laws
Education / Work Experience:
The position requires, at minimum, a college degree or equivalent business discipline preferred. 10+ years liability claim handling experience with 3-5 years experience handling serious construction defect and complex liability claims preferred (casualty claim operations environment determining coverage, liability, investigation, research, evaluation, negotiation and settlement). Knowledge of jurisdictions, laws & regulations, case law and attorneys is desirable.
Thorough understanding of product lines, objectives of claim management, and legal theory issues involving claim resolution. Familiarity with commercial and construction lines products, policy language, exclusions, ISO forms, effective claims handling practices.

Thorough understanding of the litigation process, relevant case and statutory law.
Ability to recognize, analyze and resolve complex coverage, liability and damage issues.
Ability to make independent decisions without involvement of supervisor.
Superior business relationships with business and marketing partners.
Expert litigation management skills.
Demonstrated influence and persuasion skills and mentoring and managing other staff when necessary.
Advanced written and verbal communication skills to understand, synthesize, interpret and convey complex data.
